Diese AGB gelten für alle Beratungs-, Projektierungs- und Vermittlungsleistungen von VDE Immobilien.
Sie gelten für Unternehmen und Verbraucher, sofern nichts anderes vereinbart wurde.

2. Art der Dienstleistungen

VDE Immobilien erbringt u. a.:

Immobilien- & Standortberatung
Projektentwicklung, Projektbegleitung & Wirtschaftlichkeitsanalysen
Recherche- & Bewertungsdienstleistungen
Vermittlung von Geschäftskontakten zwischen Eigentümern, Investoren, Mietern oder Käufern
Unterstützung bei Verkaufs- und Vermietungsentscheidungen
Eigene Beteiligung an Immobilienprojekten

VDE Immobilien handelt nicht als Makler im klassischen Sinne, sondern als Berater, Projektierer und selbstständiger Vermittler.

3. Vertragsabschluss

Ein Vertrag kommt zustande durch:

schriftliche Vereinbarung
mündliche Absprache
Inanspruchnahme unserer Leistungen
Entgegennahme von Unterlagen oder Kontaktdaten

Mit Übermittlung von Objektdaten, Analysen oder Kontakten erkennt der Kunde diese AGB an.

4. Vergütung

Die Vergütung wird im Vorfeld schriftlich oder mündlich vereinbart.

a) Beratungsleistungen

Abrechnung nach Stunden- oder Tagessätzen.

b) Vermittlungsleistungen

Provisionsanspruch entsteht, wenn durch unsere Tätigkeit ein wirtschaftlich relevanter Kontakt oder Vertragsabschluss zustande kommt.

c) Projektierungsleistungen

Abrechnung nach Vereinbarung (Pauschale, Beteiligungsmodell oder Honorarzahlung).

Die Vergütung wird nach Rechnungsstellung sofort fällig.
Verzug tritt nach 14 Tagen ein.

5. Informations- & Weitergabeschutz

Alle Informationen, Unterlagen, Analysen und Kontakte sind vertraulich und ausschließlich für den Kunden bestimmt.
Eine Weitergabe an Dritte ist untersagt.

Falls durch unbefugte Weitergabe ein Geschäft entsteht, schuldet der Kunde die volle vereinbarte Vergütung.

6. Haftung

VDE Immobilien haftet nur für:

grobe Fahrlässigkeit

Objekt- oder Wirtschaftlichkeitsangaben basieren auf Informationen Dritter.
Für deren Richtigkeit, Vollständigkeit oder Aktualität wird keine Haftung übernommen.

7. Vertraulichkeit

Sämtliche projektbezogenen Informationen werden vertraulich behandelt.
Daten werden nur zweckgebunden verarbeitet.

8. Widerrufsrecht für Verbraucher

Verbraucher erhalten eine gesetzliche Widerrufsbelehrung gemäß §§ 312 ff. BGB.

9. Schlussbestimmungen

Es gilt ausschließlich deutsches Recht.
Gerichtsstand ist – sofern gesetzlich zulässig – der Sitz von VDE Immobilien.
Änderungen bedürfen der Schriftform.
Sollten einzelne Klauseln unwirksam sein, bleiben die übrigen gültig.
